Opening of the Mediation Center at the Intellectual Property Registry of Guatemala

On January 24, 2025, the Intellectual Property Registry of Guatemala officially inaugurated the Mediation Center of the Intellectual Property Registry, a new initiative that will provide a friendly and efficient alternative for resolving intellectual property disputes.

This center, backed by the World Intellectual Property Organization (WIPO), offers a platform that facilitates dialogue and promotes out-of-court agreements in disputes related to Copyright and Related Rights.

Services and features

  • Free of charge: Mediation services will be completely free of charge, non-profit, and available to those who voluntarily choose to use it.
  • Virtual application: Users can request mediation through an online platform provided by WIPO.
  • Case admission: The Intellectual Property Registry will evaluate each request and issue a resolution regarding the admission or rejection of the case. If accepted, a hearing will be scheduled, either virtually or in person.
  • Trained mediators: The mediators assigned have been specifically trained by WIPO, ensuring they are adequately prepared to handle cases professionally.

Mediation procedure

Once the request is accepted, a date and time will be set for the hearing. During the hearing, the parties can present their arguments, and if an agreement is reached, it may be reflected in private documents or public deeds. If no final agreement is reached, the impossibility of reaching an agreement will be documented.

  • Recorded hearings: All hearings will be recorded for control and archival purposes.
  • Hearing options: Users can choose between an online hearing or attending in person at the Registry’s office.

The Mediation Center is a key space for strengthening legal certainty and promoting confidence in the exercise of copyright and related rights in Guatemala. Additionally, the Center’s support from WIPO adds significant value to the mediation processes in the country.
