The Special Provisions for the Implementation of National Artificial Intelligence (AI), Robotics, and Other Similar Technology Projects were published in the Official Gazette of September 25, 2026, establishing a special framework that allows the National Artificial Intelligence Agency (ANIA) to promote AI, robotics, and similar technology projects through more streamlined procurement procedures tailored to the characteristics of this sector.
To qualify for these provisions, a project must be designated as a National AI, Robotics, and Other Similar Technology Project. Companies must also identify the procurement framework, incentives, and permits applicable to their participation.
Direct procurement for technology projects
Purchases and contracts related to these projects may be carried out through direct procurement, outside the standard framework established by the Public Procurement Law.
These include, among others:
- Technology, platforms, and software.
- Specialized services.
- Licenses and data.
- Computing capacity and technological infrastructure.
- Consulting and research.
- Domestic and foreign experts and specialists.
Procurement processes must be documented and justified, including verification of the supplier’s qualifications and the reasonableness of the price.
Greater flexibility for specialized technology providers
The law provides for circumstances in which contracting with a specific supplier, brand, or technology ecosystem may be necessary for reasons of compatibility, interoperability, security, support, standardization, or integration.
It also covers cases involving sole suppliers, limited availability of qualified providers, and services that are not available in the country.
Facilitated access for foreign talent
Foreign professionals hired by ANIA may work exclusively for the agency without having to obtain recognition of their academic qualifications in El Salvador, provided they certify their degree and professional authorization in their country of origin and meet the requirements established by law.
They may also obtain temporary residence permits for up to two years, renewable, for themselves and their family members, and subsequently apply for permanent residence in accordance with immigration legislation.
Streamlined permits and procedures
The competent public institutions may establish special guidelines to facilitate and expedite permits related to:
- Construction.
- Environmental matters.
- Interconnection.
- Operations.
- Customs and other procedures associated with the projects.
Potential access to tax and customs incentives
Developers, suppliers, operators, investors, and other participants may qualify for existing tax, customs, or incentive regimes, provided they meet the applicable requirements.
The new framework may facilitate private-sector participation in national technology projects, creating opportunities for infrastructure providers, technology companies, AI developers, researchers, consultants, investors, and international specialists.
