
GarciaBodan advised ContactPoint360 on its establishment in El Salvador and the procurement of tax incentives under the International Services Law, a process that will enable the company to commence operations as an international contact center and strengthen the country’s customer experience services sector.
The engagement was led by our Managing Partner, David Claros, and our Associate, Daniel López, who assisted the client from the initial structuring of its corporate presence in El Salvador through the successful authorization process before the relevant authorities.
The project included the incorporation and registration of the company, as well as the completion of the required registrations before the Salvadoran authorities. Subsequently, the team advised the company throughout the process of obtaining the incentives available to international contact centers (commonly known as call centers) under the International Services Law.
Among the incentives obtained are a 100% exemption from Income Tax on income generated from the authorized activity and a 100% exemption from municipal taxes levied on the company’s assets throughout its authorized period of operation in the country.
Throughout the process, GarciaBodan provided legal counsel regarding the preparation of the required corporate and regulatory documentation, including the registration of foreign investment capital and the authorization of the Service Center before the Ministry of Economy.
The team also monitored each stage of the authorization process through the issuance of the favorable resolution, including all post-approval requirements, such as the publication of the corresponding resolution in the Official Gazette and notifications to the relevant governmental entities. In addition, the firm assisted the client during inspections conducted by Ministry of Economy officials to verify compliance with the applicable legal requirements.
One of the main challenges of the project was the complexity of the authorization process, which requires detailed information regarding the company’s operational projections and the timely response to observations raised by the various government agencies involved. To address these challenges, the team implemented a strategy of ongoing coordination with the competent authorities, particularly the Ministry of Economy and the Ministry of Finance, to ensure compliance with all legal requirements and facilitate the resolution of regulatory contingencies.
