{"id":44823,"date":"2026-04-06T14:51:47","date_gmt":"2026-04-06T20:51:47","guid":{"rendered":"https:\/\/garciabodan.com\/?p=44823"},"modified":"2026-04-06T15:16:56","modified_gmt":"2026-04-06T21:16:56","slug":"amendments-to-the-special-law-on-migration-and-foreigners-of-el-salvador","status":"publish","type":"post","link":"https:\/\/garciabodan.com\/en\/amendments-to-the-special-law-on-migration-and-foreigners-of-el-salvador\/","title":{"rendered":"Amendments to the special law on migration and foreigners of El Salvador"},"content":{"rendered":"<p>The amendments to <strong>El Salvador\u2019s Special Law on Migration and Foreigner<\/strong>s were published in the Official Gazette of March 23, 2026, aimed at strengthening controls over the stay of temporary residents and updating naturalization and nationality processes.<\/p>\r\n<p>&nbsp;<\/p>\r\n<h2><span style=\"color: #2263aa;\"><strong>Temporary residence<\/strong><\/span><\/h2>\r\n<p>Articles 49(5) and 119 were amended to establish parameters for length of stay in the national territory:<\/p>\r\n<ul>\r\n\t<li><strong>Minimum stay requirement:<\/strong> All temporary residents must remain in the country for at least 90 calendar days per year.<\/li>\r\n\t<li><strong>Counting method:<\/strong> Days of stay may be consecutive or cumulative within the relevant year.<\/li>\r\n\t<li><strong>Exceptions:<\/strong> Justifications will only be accepted in cases of force majeure or unforeseen circumstances, subject to approval by the General Directorate of Migration and Immigration.<\/li>\r\n\t<li><strong>Penalty for non-compliance:<\/strong> Failure to meet this minimum period constitutes direct grounds for cancellation of temporary resident status.<\/li>\r\n<\/ul>\r\n<p>&nbsp;<\/p>\r\n<h2><strong><span style=\"color: #2263aa;\">Nationality<\/span><\/strong><\/h2>\r\n<p>The amendments seeks to facilitate access to nationality for minors under 18 years of age born abroad before their parents acquire Salvadoran nationality, as well as to regulate its retention:<\/p>\r\n<ul>\r\n\t<li><strong>Children of parents who have not yet acquired Salvadoran nationality:<\/strong> Minors under 18 born abroad, prior to their parents obtaining Salvadoran nationality by birth or naturalization, may be recognized as Salvadoran upon application by their parents.<\/li>\r\n\t<li><strong>Confirmation of intent:<\/strong> Upon reaching the age of majority, they must formally express their intention to retain Salvadoran nationality.<\/li>\r\n<\/ul>\r\n<p>&nbsp;<\/p>\r\n<h2><span style=\"color: #2263aa;\"><strong>Grounds for loss of nationality by naturalization<\/strong><\/span><\/h2>\r\n<ul>\r\n\t<li><strong>Loss due to absence:<\/strong> Naturalized citizens will lose their nationality if they reside for more than <strong>two consecutive years<\/strong> in their country of origin or remain outside El Salvador for more than <strong>five consecutive years<\/strong>, unless they have obtained authorization to remain abroad.<\/li>\r\n\t<li><strong>Loss due to criminal offenses:<\/strong> Irrevocable loss of nationality by naturalization is established upon a final conviction for <strong>serious intentional crimes.<\/strong><\/li>\r\n<\/ul>","protected":false},"excerpt":{"rendered":"<p>The amendments to El Salvador\u2019s Special Law on Migration and&#8230;<\/p>\n","protected":false},"author":7,"featured_media":44820,"comment_status":"closed","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"_acf_changed":false,"inline_featured_image":false,"footnotes":""},"categories":[229],"tags":[],"class_list":["post-44823","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-news"],"acf":[],"_links":{"self":[{"href":"https:\/\/garciabodan.com\/en\/wp-json\/wp\/v2\/posts\/44823","targetHints":{"allow":["GET"]}}],"collection":[{"href":"https:\/\/garciabodan.com\/en\/wp-json\/wp\/v2\/posts"}],"about":[{"href":"https:\/\/garciabodan.com\/en\/wp-json\/wp\/v2\/types\/post"}],"author":[{"embeddable":true,"href":"https:\/\/garciabodan.com\/en\/wp-json\/wp\/v2\/users\/7"}],"replies":[{"embeddable":true,"href":"https:\/\/garciabodan.com\/en\/wp-json\/wp\/v2\/comments?post=44823"}],"version-history":[{"count":3,"href":"https:\/\/garciabodan.com\/en\/wp-json\/wp\/v2\/posts\/44823\/revisions"}],"predecessor-version":[{"id":44827,"href":"https:\/\/garciabodan.com\/en\/wp-json\/wp\/v2\/posts\/44823\/revisions\/44827"}],"wp:featuredmedia":[{"embeddable":true,"href":"https:\/\/garciabodan.com\/en\/wp-json\/wp\/v2\/media\/44820"}],"wp:attachment":[{"href":"https:\/\/garciabodan.com\/en\/wp-json\/wp\/v2\/media?parent=44823"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"https:\/\/garciabodan.com\/en\/wp-json\/wp\/v2\/categories?post=44823"},{"taxonomy":"post_tag","embeddable":true,"href":"https:\/\/garciabodan.com\/en\/wp-json\/wp\/v2\/tags?post=44823"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
